Timothy G. Warner is a partner whose practice consists primarily of representing clients in commercial and business litigation, ERISA litigation, employment litigation, probate litigation and litigation prevention counseling. Tim also counsels clients in business and employment related matters. A growing portion of his practice involves creditors’ rights, debt collection and the representation of creditors in pre-bankruptcy counseling and bankruptcy litigation.
Tim has handled complex business, commercial and employment related cases for a diverse group of companies and individuals. As a result of his commitment to representing clients wherever he is needed, he has had the opportunity to represent clients in the courts of Ohio, California, Delaware, Iowa, Maryland, Michigan, North Carolina, New York, New Jersey, Pennsylvania, South Carolina, Texas, and Washington.
Tim recently handled multiple ERISA related cases in Federal and state court for a number of Blue Cross entities, including a class action case involving ERISA, the Federal Class Action Fairness Act (CAFA) and the Health Insurance Portability and Accountability Act (HIPAA). He has extensive experience in class action litigation and multidistrict litigation.
With a strong background in product liability litigation, Tim has handled product liability cases for multiple entities involving an assortment of products including copiers, hydraulic dumpers, metal plating, printers, and scissor lifts. Tim has also handled asbestos, Dalkon Shield, and other mass tort matters.
In addition, Tim represents architects and contractors in all aspects of construction litigation, subpoenas, depositions and mechanics’ lien issues, including mediations and arbitrations.
In the probate area, he has handled a number of matters, including Executor of the Estate of Kenneth L. Cook v. Stout, Tuscarawas County Common Pleas Court Case No. 01 CV 120707, which, after trial, resulted in a judgment mandating the full recovery of all assets to the estate.
Tim previously served as the Chairman of the Litigation Section of the Cleveland Bar Association and has been recognized as one of Ohio’s Super Lawyers. Tim also previously served as a law clerk with the Honorable Alice M. Batchelder of the U.S. Court of Appeals for the Sixth Circuit.
A graduate with honors from Indiana University of Pennsylvania and Syracuse University College of Law, Tim served as an editor of the Syracuse University Law Review and was one of only six students who had his Note published. While a third year student at Syracuse, he was chosen to teach a first year legal writing course. He also previously served as an Adjunct Professor at the Cleveland Marshall College of Law and, prior to attending law school, spent four years working for Members of the U.S. House of Representatives. He is admitted to practice in the states of Ohio and Pennsylvania and in the U.S. District Court for the Northern District of Ohio, the U.S. District Court for the Southern District of Ohio, the U.S. Bankruptcy Court for the Northern District of Ohio, the U.S. Bankruptcy Court for the Southern District of Ohio, the U.S. Court of Appeals for the Sixth Circuit, and the U.S. Supreme Court.
Tim is active in his community, serving as a member of his church's Parish Council and as a member of the Board of Directors of The Gathering Place (a caring community for those touched by cancer). He is also a member of the Advisory Committee of ideastream and is active in The City Club.
